RUGSTORM guarantees products are:
- Be free from defects in materials and workmanship under normal use and service for a period of twenty-four (24) months from the date of delivery to Buyer;
- Complies with RUGSTORM’s specifications and user manual. RUGSTORM is under no obligation to modify or update products once sold.
If RUGSTORM determines that a product is defective due to a defect in material and workmanship, RUGSTORM’s obligation for the defective product shall be limited to repair or replacement free of charge (at RUGSTORM’s option). Buyer is responsible for shipping the goods to RUGSTORM and bears all costs and risks associated with such shipping; RUGSTORM is responsible for refunding the shipping cost to Buyer. If RUGSTORM determines that there are no defects (“No Defects Found”) or are not eligible for warranty repair, RUGSTORM shall charge Buyer for return shipping and a minimum repair fee.
In this warranty, repair means the repair or adjustment of a product to remedy a defect as defined in this warranty and to restore the product to normal operating condition. RUGSTORM can make up for deficiencies in RUGSTORM’s selection with new or refurbished parts. Replacement means RUGSTORM replaces a product with the same construction or equivalent construction as the original. Any replaced parts or products shall belong to RUGSTORM and replacement parts or products shall belong to Buyer. However, repair and/or replacement of the product shall not extend the original applicable warranty period.
The buyer may be required to provide RUGSTORM with the date of delivery of the product and evidence of the original contract with RUGSTORM.
The warranty does not apply to defects caused by:
- improper or inadequate customer maintenance;
- Software provided by customers or third parties;
- Unauthorized modification;
- Improper use or operation beyond the specified conditions of the product, improper site preparation;
- Abuse, neglect, accident, liquid spill, natural disaster such as flood or lightning, loss or damage in transit;
- Unauthorized maintenance or repairs.
Except for title, the above warranties are exclusive of and in lieu of all other warranties, written or oral, express or implied, statutory or otherwise. NO IMPLIED STATUTORY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE are made. RUGSTORM is not bound by any representations or warranties made by any other person, including dealers, distributors, dealers and employees of Gutab. Gutab shall not be liable for indirect, incidental or consequential damages, and liability shall not exceed the actual amount paid to RUGSTORM for the Products. In no event shall RUGSTORM be liable for damages suffered by resellers or their buyers as a result of using products beyond their intended use.
